2.1 ILUMIX collects and processes personal data provided by its customers (consumers and businesses).

2.2 ILUMIX stores and processes personal data and other data in accordance with the applicable laws of the Czech Republic, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as the "Regulation"), Act No. 110/2019 Coll., on the processing of personal data, as amended, and Act No. 480/2004 Coll., on certain information society services, as amended.

2.3 As the operator of the website www.360design.cz (hereinafter referred to as the "Website"), ILUMIX uses cookies and system data on the Website.

2.4 ILUMIX acts as a controller in the processing of personal data and thus determines for what purpose and by what means the personal data will be processed.

2.5 This Policy informs Subscribers about the manner and extent of ILUMIX's processing of their personal data and other data, including the extent of their rights related to ILUMIX's processing of their personal data and other data.

3.1 Personal Data of Subscribers means any information that identifies or can identify a specific natural person.

3.2 ILUMIX obtains personal data of customers in connection with the purchase of goods or the use of ILUMIX services (handling complaints, inquiries, setting up and maintaining a customer account). This personal data includes:
(a) name and surname,
(b) the address of residence or delivery address,
(c) email address,
(d) a telephone number,

3.3.ILUMIX obtains other data from customers in connection with the purchase of goods or the use of ILUMIX services (handling of complaints, inquiries, setting up and maintaining a customer account). These additional data are:
(a) IP address,
(b) browser and device details,
(c) cookies,
(d) geographical data.

3.4 ILUMIX, as the controller, shall process the personal data and other data of the subscribers only in accordance with the purposes set out in this Policy, to the extent and for the time necessary for the fulfilment of such stated purposes.

4.1 ILUMIX collects and processes personal data and other data of Subscribers and visitors to the Website through the execution of orders, registration for commercial communications, handling of complaints and cancellations or other communications between ILUMIX and the Subscriber.

4.2 ILUMIX collects and processes personal data and other data of Subscribers for the purposes of:
(a) the execution of orders and the exercise of rights and obligations arising from the contractual relationship between ILUMIX and customers, where it collects personal data necessary for the successful execution of the order and the provision of data is a prerequisite for the conclusion and performance of the contract,
(b) dealing with customer complaints and enquiries, collecting personal data necessary for the successful handling of the complaint or enquiry,
(c) the establishment and maintenance of a customer account for customers, collecting personal data necessary for the successful conclusion and performance of the contract and the processing of customer orders,
(d) after obtaining the prior consent of subscribers for sending commercial communications,
(e) with the prior consent of subscribers for marketing purposes,
(f) after obtaining the prior consent of customers in determining customer satisfaction with purchases or services from ILUMIX,

4.3 The lawful reason for collecting and processing personal data and other data of the subscribers is:
(a) the performance of the contract between ILUMIX and the customers,
(b) the fulfilment of ILUMIX's legal obligations (e.g. under the laws governing bookkeeping or archiving),
(c) ILUMIX's legitimate interest in sending commercial communications and providing direct marketing to subscribers,
(d) ILUMIX's legitimate interest in determining customer satisfaction with purchases or services provided by ILUMIX,
(e) consent to the sending of commercial communications and processing for marketing purposes in the absence of an order for goods or services.

4.4 ILUMIX does not make automatic individual decisions.

5.1 In accordance with the Regulation, Customers have the right to:
(a) to access their personal data,
(b) to rectify their personal data or to restrict their processing,
(c) to have their personal data erased,(d) to object to the processing of their personal data and other data,
(e) to the portability of their personal data,
(f) withdraw consent to the processing of your personal and other data,
(g) to restrict the processing of their personal data,
(h) request the termination of the processing of your personal data,
(i) lodge a complaint and/or complaint with the Data Protection Authority.

5.2 Subscribers may exercise their rights under paragraph 5.1 of this Policy by sending a written request to ILUMIX at info@ilumix.cz .

5.3 The implementation of the Subscribers' right under paragraph (e) of this Policy shall be carried out by ILUMIX transmitting to the Subscribers, upon prior request by the Subscribers, the Personal Data and other data provided in electronic form.

5.4 Subscribers can withdraw their consent to receive commercial communications and cancel the receipt of commercial communications by clicking on the "Unsubscribe from newsletter" link in the e-mail message containing the commercial communication or by sending a request to the e-mail address info@ilumix.cz .

6.1 ILUMIX has ensured the necessary technical and organisational measures to secure personal data and other data of the Subscribers.

6.2 ILUMIX has provided the necessary technical measures to secure data storage and storage facilities for personal data and other data of Subscribers stored in paper form.

6.3 ILUMIX only allows access to personal data and other data of Subscribers by persons authorised by ILUMIX.

6.4 ILUMIX regularly checks the security of personal data and other data of the Subscribers.

7.1 ILUMIX will not disclose personal data or other data of Subscribers to third parties except:
(a) ILUMIX's vetted subcontractors as personal data processors who provide other services to ILUMIX related to ILUMIX's business activities,
(b) persons to whom ILUMIX has a legal obligation to provide personal data and other customer data.

7.2 ILUMIX provides personal data and other data of subscribers to the following data processors:
(a) For the purpose of transporting goods:

7.3 If ILUMIX transfers personal data and other data of Subscribers to another entity not specified in this Policy, it is obliged to inform the affected Subscribers in advance, including providing information about to whom it provides such data.

7.4 ILUMIX does not provide personal data and other data of Subscribers to third parties for consideration, in particular for the purpose of providing marketing services and sending advertising materials by third parties. ILUMIX does not provide personal data and other data of Subscribers to countries outside the European Union member states or to international organisations.

8.1 ILUMIX stores the personal data and other data of the customers for the period necessary for the performance of the rights and obligations arising from the contract concluded between ILUMIX and the customers or related to this contract (e.g. claims, provision of guarantees, bookkeeping, legal archiving, etc.), for a period of 10 years from the conclusion of the contract or the issuance of the tax document - invoice.

8.2.Personal data and other data of subscribers processed on the basis of subscribers' consent for sending commercial communications or marketing until the withdrawal of the consent, but no longer than 5 years.

8.3 After the retention period of personal data and other data has expired, ILUMIX deletes the personal data and other data of the Subscribers from its database.

9.1 By using the Website, Subscribers consent to the collection of cookies, which ILUMIX uses to improve the functioning of the Website, evaluate its traffic and optimize marketing activities.

9.2 Cookies are data files that are sent by the person visiting the website to the browser used, which stores them on the respective computer. These data files are used to distinguish individual users, who are not identifiable on the basis of this information. Cookies allow the activities and preferences of a computer user to be stored for a certain period of time.

9.3 Cookies are mainly used to:
(a) ensuring that the website is functioning properly to complete the ordering process,
(b) to ensure secure login, to authenticate subscribers and to prevent fraudulent use of login credentials,
(c) to protect Subscriber Data from access by unauthorized parties,
(d) storage of subscribers' login data,
(e) storing data about the selected goods for further conclusion of the contract (the so-called shopping cart),
(f) analysing the traffic, behaviour, preferences and interests of website users,
(g) offering advertising of goods according to the interest of subscribers and users.

9.4 ILUMIX uses the Website to:
Session cookies, which are only temporary files, remain stored on the user's device until the browser session ends and are deleted from the user's device when the browser is closed,

9.5 Cookies may also collect information that is subsequently used by third parties and that directly support advertising activities (so-called "third-party cookies") for the purpose of personalizing the display of online advertising on websites viewed by the device user, but do not allow the device user to be personally identified.

9.6 ILUMIX uses the following types of cookies on the Website:
(a) operational technical cookies (necessary to ensure the basic functionality and security of the Website) as mandatory,
(b) Functional cookies (to remember basic user settings and preferences)
(c) analytics cookies (to improve the performance of the Website),
(d) advertising and marketing cookies (to personalise the Website and advertising).

9.7 Consent to the use of functional, analytical, advertising and marketing cookies is voluntary. If the Website user does not consent to the collection of some or all cookies, he/she can exclude their collection by changing the settings of his/her browser or withdrawing the consent.
